The NYC Council approved a year-round outdoor dining plan Aug 2. The plan will allow more restaurants and cafes to apply for outdoor seating but with changes to current Emergency rolled out in 2020 when covid-19 ravaged the city restaurant industry.
Provisions of the new plan will allow curbside set-up (provided the business has valid permits) from April 1 through Oct 31 with no outdoor “shed” dining from Nov 1 through Mar 31. The current outdoor dining sheds will also be drastically changed from its current “as you please” buildouts. Currently the outdoor sheds were allowed to be enclosed with walls and roofs but that will change under the new provisions to traffic barrier only with no walls or roofs. Hours of operation will also be changed to 10am-12 midnight.
Applicants for outside dining will have to appear before its respective community board for approval before the NYC DOT issues a permit.
The bill awaits mayoral approval, but Mayor Adams is in support of outside dining. The plan if approved will go into effect Nov 1, 2024, which leaves plenty of time for tweaking and lobbying by the hospitality industry.
